terms of service

Please read them before you commission me. To see if my commisions are open look at my carrd, social media or ask through the links at the bottom of this page.Here is my commission sheet with more information listed.

General Guide

⁃ Please read the list above of what i will and will not draw.
⁃ I’m allowed to not accept your commission without giving a reason.
⁃ Contact me letting me know which type of commission and amount of art you'd like, as well as include the information below;
⁃ Include a visual reference of the character(s) you want to have drawn, any details you want included that aren’t portrayed in the reference please describe in detail for an accurate depiction in the art.
(alternatively you may request for me to interpret the missing details, won't do this for everything though- feel free to ask)
⁃ If you want a specific pose or if you’re commissioning a scene please provide some sort of reference or description.
⁃ If you want a simple background please specify what color/gradient etc you'd like. Small scenes like for example sunset field or dark street count as complex background.Optional form is available here

Payment

⁃ I only accept USD via PayPal
⁃ You have to pay full price upfront, for colored commissions payment can be after the sketch. Can discuss a payment plan if the total price amounts to $100 or above.(with a payment plan you will not receive an unwatermarked version until the final part of the payment is completed.
For adoptables, must complete payment plan before being given rights to the design.
Must be able to pay within the discussed time frame.)

Process

⁃ After you’ve followed the guide above and you’ve payed i will begin sketching your commission, and i’ll send you the result. You can still ask for major adjustments in this stage, use this chance if you’re not satisfied with how the art is turning out. Please specify what you would like changed if that is the case.
⁃ I will update you on the progress and once i start the lineart you can ask for minor changes (for example detail, expression, color shade/hue etc.).
⁃ The image will be delivered in .png format unless you ask otherwise.
⁃ The work should be finished within 1-3 weeks, if it takes longer you will be notified.

Use: commissions

⁃ The art is only for personal use: do not sell it nor make products with it that you profit from. If interested in commercial use it must be discussed before payment, a one-time fee will apply.
⁃ I am allowed to use the commisioned art for self-promotion, example images for my commisions etc.
⁃ If you want to, you can request to have your username be anonymous whenever i post the art you commissioned. Typically i'll ask beforehand.
⁃ You may upload the art you commisioned from me to social media as long as you provide proper credit
(for example: "Art by @Qiniac on [instagram/toyhouse]").

Use: Adoptables/customs

⁃ The character design is primarily for personal use: do not make commercial products with the art i initially made and sold of the design, it is only okay if you make your own art or use art you have the right to sell to include said character design in the product.
⁃ You are allowed to resell the character for the price you bought it for and/or the value of commissioned art including this character which you paid for.
⁃ If there is an emergency and you need to sell the character for more than you bought it for, please contact me beforehand. Do not inflate the price without a fair reason.
Otherwise if I see you for example selling a character you got for $10 for $50 without reason you will be blacklisted.
⁃ I am allowed to use the art of that character I sold you for self-promotion, example images for my customs etc.
⁃ You may upload the art I made of the character you own to social media as long as you provide proper credit
(for example: "Art by @Qiniac on [instagram/toyhouse]").

Refunds and cancellations

⁃ refunds are not applicable for sketch commissions
⁃ If you payed, but you cancel your commission before I begin working on the lineart you will receive a 50% refund.
⁃ If you payed, but you cancel your commision after I consulted you, you accepted the sketch and I have begun with the lineart phase you will not recieve a refund.
⁃ If you cancel your commision because I unjustifiably cannot or if I do not want to finish it you will receive a full refund.
⁃If you cancel or fail to pay a payment plan you will not receive a refund. In the case that you cancel a payment plan on an adoptable or custom, I retain the right to sell the design to someone else. I will not wait longer than a week if i am ghosted.

Blacklist

My blacklist is not public as to prevent harassment. The only exception are individuals who are dangerous and need to be kept an eye on regargless of whatever new identity they take on.
Nonetheless, i always do a background check on my clients regardless of who they are- and if you appear on my blacklist then depending on severity expect to remain permanently blocked from my service on all your accounts.
Some misunderstandings or emergencies can be excused.You will end up on the blacklist if you;
⁃ Chargeback the payment without any giving any solid reason and/or without warning me beforehand
⁃Ghost me after we made an agreement, not pay the price within the time frame we agreed upon, even after being reminded
⁃ Act disrespectful/entitled towards me, or just generally act disrespectful without consideration for others
⁃ Actively say or support content, ideas or people who act or advocate against basic human rights
⁃ Request art that is very clearly on my "won't draw" list
